Introduction

1. (1) GCIS hereby introduces a South Africa 2010 website: www. sa2010.gov.za (“the website”). The purpose of this website is to provide information about and regarding South Africa’s preparedness for the 2010 FIFA World Cup for Government Communication and Information System (GCIS).

(2) By accessing and using the website, the user, agree to be bound by the terms and conditions that are set out in this notice. If you do not wish to be bound by these terms and conditions, then you may not access, display, use, download and/or otherwise copy or distribute any of the content of this website.

Your use of the website
2. (1) The user shall use the website for lawful purposes and the user warrants he or she shall not –
(a) use the website for transmission of “junkmail”, “spam”, “chain”, letters, or unsolicited mass distribution of SMS;
(b) you agree that your use of this website is for lawful purposes only; and
(c) You agree that you will not use this website for unlawful purpose, including but not limited to: to the commission of a criminal offence; to gain unauthorised access to other computer systems; or for the transmission of unlawful material.

Applicable law
4. (1) This website is owned and operated within the Republic of South Africa. These terms and conditions will be governed by and construed with the laws of South Africa, and you shall submit to the jurisdiction of the South African Courts in the event of any dispute.

(2) These terms and conditions are severable, in that if any provision is determined to be illegal or unenforceable by any court of competent jurisdiction, then such provision shall be deemed to have been deleted without affecting the remaining provisions of terms and conditions.

(3) GCIS failure to exercise any particular rights or provision of these terms and conditions shall not constitute a waiver of such right or provision, unless acknowledged and agreed by us in writing.

(4) These terms and conditions, as varied by us from time to time constitute the sole agreement between yourself and GCIS.

(5) These terms and conditions shall be for the benefit of GCIS and may be waived by us in our discretion.

Whilst every effort is made to ensure that the information provided on the website is current and accurate, you should not assume that the information on the website is always current or accurate, and other sources of this information should be consulted before making any decision to act on the information displayed on this website.

6. (1) GCIS shall ensure that it respects the privacy of the users or visitors to the site.
(2) The user may use the site without providing personal information. However, for GCIS to be able to continue providing optimum services, shall engage in an exercise in respect of which it will be gauging popularity of the site and for the purposes of communication, improvement of the site for visitors sake, we may collect information on the number of visits to the site, pages viewed and any further related information.

(3) The user’s or visitor’s attention is drawn to the fact that information transmitted via the Internet is susceptible to monitoring and interception. The user is therefore discouraged from transmitting to the Website or Website owner any information that may be confidential, proprietary, or shall bear all risk of transmitting such information in this manner and under no circumstances shall the GCIS be liable for any loss, harm, or damage suffered by the user.

(2) All associated logos and symbols and combinations of any of the aforegoing with another word or mark, used in this site, are the intellectual property of GCIS, or any of its parastatals.
(3) GCIS retains copyright in the website and all current and future content that is displayed on the website which is not owned by the third parties.
(4) In terms of a limited licence, granted for general use, GCIS grants you, the user, subject to these terms and conditions, a non-exclusive, non-transferable, limited and revocable right to access, display, use, download and otherwise copy the current and future content of the website for your personal, non-commercial and information purposes only
(5) GCIS grants the user permission to copy and distribute information from the website provided that the source of the information is acknowledged by reference to the source.
(6) The website and content may not be reproduced, duplicated, copied, resold or otherwise exploited for any commercial purpose without the express prior written consent.
