Merchandise Marks Act
The Government fulfilled its guarantee to protect FIFA’s intellectual property rights and prevent “ambush” marketing by designating the World Cup as a protected event in terms of Section 75A of the Merchandise Marks Act 17 of 1941. This designation was effected by a notice in the Government Gazette (Notice 683 of 2006).
The designation applies from the date of the publication of the notice in the Government Gazette (25 May 2006) until six calendar months after the 11 June, the date of commencement of the World Cup.
The Government grants protected-event status to events that are in the public interest. The declaration of the 2010 World Cup as a protected event was done with the Organising Committee’s agreement that the event be organised in a way that supports small businesses and black economic empowerment. This will enlarge the scope of economic opportunities arising from 2010.
The Merchandise Marks Act was amended by the Merchandise Marks Amendment Act 61 of 2002 to prohibit the abuse of trademarks in relation to an event.
